On September 1, 2010, the District Court entered an Order for Final Certification of the Class, Approval of Class Action Settlement, and Entry of Final Judgment. As explained in an accompanying opinion, the Court granted final class certification and approved the Settlement Agreement as fair, reasonable, and adequate. The Settlement Agreement became effective on October 2, 2010, and CertainTeed is processing and paying claims.

On October 25, 2010, the Court entered an Order approving Class Counsel’s request for fees of $21,886,199.97 and costs of $613,800.03.

On October 31, 2011, pursuant to Paragraph 6 of the Court’s Order entered August 31, 2010, and Paragraph 4.33 of the Settlement Agreement, CertainTeed filed its First Report concerning the allowance and disallowance of claims during the period October 2010 through September 2011. On November 7, 2011, when more complete date was available, it filed an Amended First Report. Since then, CertainTeed has filed reports annually at the beginning of November.

On June 19, 2012, the Court entered an Order appointing Heffler Claims Administration as the Independent Claims Administrator and appointing BrightClaim, Inc. as the Independent Inspector.

On October 28, 2013, the Court entered an Order appointing the Honorable Louis C. Bechtle, a retired judge of the United States District Court for the Eastern District of Pennsylvania, as the Special Master.

After the passing of the Honorable Louis Pollak, the judge to whom the CertainTeed Corporation Shingles Product Liability Litigation was assigned by the Judicial Panel on MultiDistrict Litigation, the Honorable Robert Kelly of that same court initially supervised the administration of the Settlement. In November 2020, the litigation was reassigned by the Judicial Panel on Multidistrict Litigation to the Honorable Timothy J. Savage, also of the United States District Court for the Eastern District of Pennsylvania.
